What to do if you are arrested for DUI
If you are pulled over for DUI in Georgia, do not speak to the police, other than to provide basic information. Be polite, respectful and cooperative. Remember, the stop may be recorded by both audio and video.
1. You do not have to answer any questions concerning alcohol or other substances consumed. Any admissions will be used against you.
2. Field sobriety tests and handheld roadside breath tests are voluntary. You are not required to take them. However, failure to do so may cause the officer to place you under arrest, if they feel they have other evidence of impairment.
2. Once you post bail and are released, request a hearing to challenge the revocation of your driver’s license. This must be done within 30 days of your arrest otherwise you may lose your license for one year.
3. Contact an experienced DUI defense lawyer as soon as possible. You may forfeit certain rights and legal defenses by waiting until your court date.
A DUI Defense lawyer can help you protect your rights, protect your license and get the best possible outcome in your case.
